Terms & Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the KankoHR platform and services (collectively, the "Services") provided by KankoHR ("we," "our," or "us"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

KankoHR provides a human resources platform designed specifically for the hospitality industry, offering features for job posting, applicant tracking, interview scheduling, and related HR functions.

2. Definitions

  • "Account" refers to a registered account on the KankoHR platform.
  • "Content" refers to any text, images, videos, or other material that is posted, uploaded, or otherwise made available through the Services.
  • "Employer" refers to companies, organizations, or individuals who use our Services to recruit and manage candidates.
  • "Job Seeker" refers to individuals who use our Services to search for job opportunities and submit applications.
  • "User" refers to any individual who accesses or uses the Services, including Employers and Job Seekers.

3. Account Registration and User Responsibilities

3.1 Account Creation

To use certain features of our Services, you must create an account. When registering for an account, you agree to provide accurate, current, and complete information and to keep this information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

3.3 User Eligibility

You must be at least 18 years old to create an account and use our Services. By using our Services, you represent and warrant that you meet this age requirement.

3.4 Employer Responsibilities

Employers agree to:

  • Comply with all applicable laws related to employment, data protection, and non-discrimination
  • Post accurate job descriptions and requirements
  • Maintain the confidentiality of candidate information
  • Use the Services only for legitimate recruitment purposes
  • Process personal data in accordance with applicable data protection laws
3.5 Job Seeker Responsibilities

Job Seekers agree to:

  • Provide accurate information in their profiles and applications
  • Not misrepresent their qualifications or experience
  • Only apply for positions for which they have a genuine interest
  • Respect the confidentiality of any information disclosed during the recruitment process

4. Subscription and Payment Terms

4.1 Subscription Plans

KankoHR offers various subscription plans for Employers. Details of these plans, including features and pricing, are available on our website. We reserve the right to modify our subscription plans at any time.

4.2 Payment Terms
  • Subscription fees are charged in advance according to the billing cycle selected (monthly or annual)
  • All payments are non-refundable unless otherwise specified in these Terms
  • You authorize us to charge your designated payment method for all fees incurred
  • Prices are exclusive of taxes unless otherwise stated
4.3 Free Trials

We may offer free trials of our Services. At the end of the trial period, your account will automatically convert to a paid subscription unless you cancel before the trial ends.

4.4 Billing and Renewal

Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings.

4.5 Price Changes

We reserve the right to change our prices. Any price changes will take effect at the start of the next billing period following notice of the change.

5. Acceptable Use Policy

5.1 Prohibited Activities

You agree not to:

  • Use the Services in any manner that could damage, disable, overburden, or impair the Services
  • Use automated methods or scripts to access or scrape data from the Services
  • Upload or transmit any viruses, malware, or other malicious code
  • Attempt to gain unauthorized access to any portion of the Services
  • Use the Services for any illegal purpose or in violation of any local, state, national, or international law
  • Discriminate based on race, color, religion, gender, sexual orientation, national origin, age, disability, or any other protected category
  • Post false, misleading, or fraudulent content
  • Harass, intimidate, or threaten any other users
  • Infringe the intellectual property rights of others
5.2 Content Standards

All Content must comply with these Terms and must not:

  • Be defamatory, obscene, or offensive
  • Promote discrimination, bigotry, racism, or hatred
  • Contain sexually explicit material
  • Promote violence or harm against any person or entity
  • Infringe any patent, trademark, trade secret, copyright, or other intellectual property rights
5.3 Monitoring and Enforcement

We have the right, but not the obligation, to:

  • Monitor the Services for violations of these Terms
  • Remove or refuse any Content that violates these Terms
  • Terminate or suspend access to our Services for violations of these Terms
  • Take appropriate legal action for any illegal or unauthorized use of the Services

The Services, including all content, features, and functionality, are owned by KankoHR or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit our intellectual property without our prior written consent.

6.2 License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Services for your internal business purposes or job search activities.

6.3 User Content

You retain ownership of any Content you submit, post, or display on or through the Services. By submitting Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such Content to provide and promote the Services.

6.4 Feedback

Any feedback, suggestions, ideas, or other information you provide regarding the Services may be used by us without any restriction or compensation to you.

7. Privacy and Data Protection

7.1 Privacy Policy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7.2 Data Processing

For Employers, we process personal data of Job Seekers on your behalf. You are responsible for ensuring that you have the right to collect and process such data and that you comply with applicable data protection laws.

7.3 Data Security

We implement reasonable security measures to protect your information. However, no system is completely secure, and we cannot guarantee the absolute security of your information.

8. Third-Party Services and Links

8.1 Third-Party Services

Our Services may integrate with or contain links to third-party websites, applications, or services. We are not responsible for the content or practices of these third parties, and your use of such third-party services is at your own risk.

8.2 Third-Party Integrations

We may offer integrations with third-party services (e.g., calendar applications, video conferencing tools). Your use of these integrations is subject to the terms and privacy policies of those third parties.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. WE MAKE NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE CONTENT PROVIDED THROUGH THE SERVICES.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL KANKOHR, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
  • ANY CONTENT OBTAINED FROM THE SERVICES
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES DURING THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

11. Indemnification

You agree to indemnify, defend, and hold harmless KankoHR, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your Content
  • Any actions taken using your account

12. Term and Termination

12.1 Term

These Terms will remain in effect until terminated by either you or us.

12.2 Termination by You

You may terminate these Terms at any time by closing your account and discontinuing use of the Services.

12.3 Termination by Us

We may terminate or suspend your account and access to the Services at any time, without prior notice or liability, for any reason, including if you breach these Terms.

12.4 Effect of Termination

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Changes to These Terms

We may revise these Terms from time to time at our sole discretion. All changes are effective immediately when posted and apply to all access to and use of the Services thereafter. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of Japan, without giving effect to any principles of conflicts of law.

14.2 Dispute Resolution

Any dispute arising from or relating to these Terms or the Services shall be finally settled by arbitration in Tokyo, Japan, in accordance with the rules of the Japan Commercial Arbitration Association. The arbitration shall be conducted in the English language by one arbitrator appointed in accordance with such rules.

14.3 Exceptions

Nothing in these Terms shall prevent either party from seeking injunctive or other equitable relief from the courts for matters related to data security, intellectual property, or unauthorized access to the Services.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and us regarding the Services.

15.2 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

15.3 Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced to the fullest extent under law.

15.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without your consent.

15.5 No Agency

No agency, partnership, joint venture, or employment relationship is created as a result of these Terms, and neither party has any authority of any kind to bind the other in any respect.

15.6 Force Majeure

We shall not be liable for any failure or delay in the performance of our obligations under these Terms arising from causes beyond our reasonable control, including acts of God, natural disasters, pandemic, terrorism, war, riot, government actions, or internet disruptions.
